Sailaja Kiran Conroversies – Sailaja Kiran, Ramoji Rao Share Transfer Case

On October 19, 2023, the Andhra Pradesh High Court issued temporary orders to stop any further action against Margadarsi Chit Fund Private Limited (MCFPL) Chairman Ch Ramoji Rao and Managing Director Ch Sailaja Kiran for eight weeks. This was in relation to a case filed by the Andhra Pradesh Crime Investigation Department (APCID) for allegedly threatening a person and fraudulently transferring his shares to Sailaja Kiran. The court also instructed the CID not to take any forceful action against them.

The CID had filed the case on October 13 after a complaint by Gadireddi Yuri Reddi, who claimed that Ramoji Rao threatened him at gunpoint to transfer his shares to Sailaja Kiran. On October 16, Ramoji Rao and Sailaja Kiran petitioned the High Court to dismiss the FIR.

During the hearing, the petitioners’ lawyers, Sidharth Luthra and Nagamuthu, argued that the government was harassing their clients by filing these cases. They said Yuri Reddi was paid by cheque for his shares, and although he signed the transfer documents, he later complained to the Registrar of Companies and then to the CID.

The lawyers argued that since MCFPL and the share transfer were based in Hyderabad, the APCID had no jurisdiction. They also noted that Sailaja Kiran was not directly accused but was still named in the FIR.

APCID’s lawyer, Y Sivakalpana Reddy, argued that the complaint was made to their agency because it was already investigating MCFPL for other issues. They stated that the investigation was incomplete and requested the court not to issue interim orders. They suggested transferring the case to the Telangana CID if jurisdiction was an issue.

Justice BVLN Chakravarthi questioned how the APCID could file a case for an alleged offense in Telangana and ordered a halt to all proceedings. The court asked the CID to respond and set the next hearing for December 6.
